Terms of Use

1. Agreement

These Terms of Use govern your use of properkey.us and the services offered through it (the "Site"), operated by Properkey Corp. ("Properkey," "we," "us"). By using the Site, creating an account, or submitting information through it, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Site.

2. Who we are

Properkey Corp. is a licensed real estate broker in California (DRE #01979718) and Idaho (#CO58069), and offers real estate brokerage services only in those two states. Mortgage lending is offered through Properkey Loans (NMLS #1438783) and insurance through Properkey's licensed insurance agency. Every license is listed in the Licensure section at the bottom of each page.

3. No agency or client relationship

Using the Site, creating an account, requesting information, or talking with our chat or phone assistant doesn't make Properkey your real estate agent, broker, lender or insurance agent, and doesn't create an agency, fiduciary or client relationship. That relationship begins only when you and Properkey sign a written agreement, such as a listing agreement or a buyer representation agreement.

4. Property and listing information

Listing information comes from multiple listing services (CRMLS, MetroList and Fresno MLS), public records and other third-party sources. It is deemed reliable but isn't guaranteed. Square footage, lot size, school assignments and other details may be wrong or out of date, and a listing may already have sold or been withdrawn. Home values, price ranges and savings figures on the Site are estimates, not appraisals or offers. Verify anything that matters to your decision with the listing agent, a licensed appraiser, an inspector or the appropriate public agency.

5. No legal, tax or financial advice

Articles, calculators, FAQ answers and replies from our assistants are general information. They aren't legal, tax, accounting, investment or financial advice. Talk to a qualified professional about your own situation.

6. Automated and AI-generated content

The Site uses automated tools, including artificial intelligence, to prefill listing details from public records and MLS data, tag and describe photos, answer questions in chat and by phone, and summarize documents. This content can contain errors. When you create a listing, you are responsible for reviewing every prefilled detail and confirming it's accurate before you submit it, and a Properkey agent reviews your listing before it goes to the MLS. Replies from our chat and phone assistants are informational and don't commit Properkey to any price, term or promise. Calls to Properkey are recorded and may be transcribed, and our phone assistant tells you so at the start of every call.

7. Electronic communications and signatures

By creating an account or giving us your contact information, you agree that we may send you notices, disclosures and other communications electronically, by email, on the Site, or by text message where you've agreed to receive texts. Documents you sign electronically, including through DocuSign, are as binding as documents signed on paper. You can ask for a free paper copy of anything you signed electronically, or withdraw your consent to electronic delivery, by emailing [email protected]; if you withdraw, we may not be able to continue a transaction that depends on electronic signing. Keep the email address on your account current. To receive and keep electronic records you need a current web browser, an email account and a way to view and save PDF files.

8. Your account

You must be at least 18 to create an account. Give accurate information, keep your password and passkeys secure, and tell us right away at [email protected] if you think someone else has used your account. You're responsible for activity under your account.

9. Acceptable use

You agree not to:

• use the Site for anything unlawful or anything these Terms prohibit;
• copy, scrape, harvest or index listing data, photos or other content with bots or other automated means, or republish it;
• use MLS data for any purpose other than evaluating property for your own purchase, sale or lease;
• submit false listings or false information, or content you don't have the right to share;
• harass, threaten or discriminate against anyone, including our staff;
• interfere with the Site's security or operation, or try to reach any part of it you haven't been given access to; or
• impersonate anyone.

We may remove content or suspend or end your access if you break these rules.

10. What you submit

You keep ownership of the photos, descriptions, documents and other content you submit ("Submissions"). You give Properkey a non-exclusive, royalty-free license to use, copy, edit, display and distribute your Submissions to provide our services, including marketing your property through the MLS and the websites it shares listings with, and to operate and improve the Site. You confirm you have the rights needed to grant this license. We may remove any Submission at our discretion.

11. Third-party sites and services

The Site links to and works with services we don't control, including MLS data providers, mapping services, lenders, insurance carriers and e-signature tools. We aren't responsible for their content or practices, and a link isn't an endorsement.

12. Copyright and trademarks

The Site and its content, other than MLS data and your Submissions, belong to Properkey Corp. or its licensors and are protected by copyright and trademark law. PROPERKEY is a registered trademark registration number 88926694 and CA service mark 02004815. LOANVANA is a registered trademark registration number 90140660 and CA service mark 02004818. CLOSEVANA is a pending trademark and CA service mark 02004816. FREEALTY is a registered trademark registration number 86560798. The names of other companies and products on the Site may be the trademarks of their owners. Any rights not expressly granted in these Terms are reserved.

13. Copyright complaints

If you believe content on the Site infringes your copyright, send a notice under 17 U.S.C. § 512(c)(3) to our designated agent: Copyright Agent, Properkey Corp., 16950 Via de Santa Fe Suite 5060-141, Rancho Santa Fe, CA 92067, [email protected]. Include your signature, the work you say is infringed, the material on the Site and where it appears, your contact information, a statement that you believe in good faith the use isn't authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner.

14. Disclaimers

THE SITE AND EVERYTHING ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, PROPERKEY AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND MAKE NO PROMISE THAT THE SITE OR ITS INFORMATION IS ACCURATE, COMPLETE, CURRENT OR AVAILABLE WITHOUT INTERRUPTION.

15. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, PROPERKEY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. SOME STATES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU. THESE TERMS DON'T LIMIT ANY LIABILITY THAT CAN'T BE LIMITED BY LAW, AND THEY DON'T CHANGE THE TERMS OF ANY WRITTEN AGREEMENT YOU SIGN WITH PROPERKEY.

16. Ending access

We may suspend or end your access to all or part of the Site at any time. Sections 4 through 7, 10 and 12 through 17 continue to apply after your access ends.

17. Governing law

California law governs these Terms, and you agree to the exclusive jurisdiction and venue of the state and federal courts in San Diego County, California, for any dispute about the Site. If a court finds part of these Terms unenforceable, the rest stays in effect. These Terms, together with any written agreement you sign with Properkey, are the entire agreement between you and Properkey about the Site.

18. Changes to these Terms

We may update these Terms. The effective date at the top of this page shows when they last changed, and continuing to use the Site after a change means you accept it.
